Section 01
About NilPilot
NilPilot is a NIL (Name, Image, and Likeness) management platform designed for college athletes. It helps you track sponsorship deals, estimate your market valuation, manage your media kit, and organize your NIL activity in one place.
NilPilot is an informational and organizational tool only. Nothing on this platform constitutes financial, legal, tax, or compliance advice. Valuations and deal estimates are generated algorithmically for reference purposes — they are not offers, guarantees, or professional assessments.
For decisions that affect your NIL eligibility, taxes, or contracts — always consult a qualified attorney, tax advisor, or certified NIL agent.
By using NilPilot, you agree to these Terms of Service. If you do not agree, please do not use the platform.
Section 02
Eligibility
You may use NilPilot if you meet all of the following conditions:

- You are not prohibited from using the platform by applicable law or institutional policy.
- By creating an account, you confirm that your use of NilPilot complies with your school's NIL policy, conference rules, and any applicable NCAA, NAIA, or NJCAA guidelines.
NilPilot does not monitor your school's specific NIL rules. It is your responsibility to ensure your activities on the platform remain compliant with your institution's requirements.
Section 03

Your Data & Intellectual Property
You own your data. The information you enter into NilPilot — your deals, stats, media kit content, and profile — belongs to you. We do not claim ownership of your content.
By using NilPilot, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your data solely for the purpose of operating and improving the service for you.
- We will never sell your individual data to third parties, advertisers, brands, or data brokers.

To keep NilPilot safe and fair for all athletes, the following are strictly prohibited:
- Impersonation — Creating an account as or on behalf of another athlete without their explicit consent.
- Scraping or automated access — Using bots, crawlers, or automated scripts to access or extract platform data.
- Fraudulent activity — Entering false deal amounts, fabricating brand relationships, or misrepresenting your metrics to inflate valuations.
- NIL eligibility violations — Using the platform in a manner that knowingly violates NCAA, NAIA, or your school's NIL rules.
- Malicious code — Uploading or transmitting viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to systems.

Section 07
Limitation of Liability
NilPilot is an informational and organizational tool. We are not a party to any NIL deal, sponsorship agreement, or contract you enter into with brands or other parties.
Valuations are estimates — not offers or guarantees. The NIL valuation figures generated by NilPilot are algorithmic estimates based on publicly available benchmarks and the data you provide. They do not represent a binding offer from any brand.
To the maximum extent permitted by applicable law, NilPilot and DRACONES Ecosystem shall not be liable for:
- Outcomes of NIL deals or sponsorship negotiations you enter based on platform data.
- Tax obligations, penalties, or implications arising from your NIL income.
- Compliance decisions or eligibility consequences related to your NIL activity.
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of data due to circumstances beyond our reasonable control.
Consult a qualified legal or financial advisor before signing any NIL deal or making tax filings related to NIL income.
Section 08
Third-Party Integrations
NilPilot may connect to or display data from third-party platforms including Instagram, Twitter/X, TikTok, and others to help power features like your media kit and social metrics.
- We are not affiliated with, endorsed by, or responsible for any third-party platform.
- Third-party services have their own terms of service and privacy policies, which apply independently of these Terms.
- If a third-party API changes or is discontinued, related features in NilPilot may be affected. We will work to restore functionality as quickly as possible.
Section 09
Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
Binding Arbitration. Any dispute, claim, or controversy arising from or relating to these Terms or your use of NilPilot shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English.
Class Action Waiver. By agreeing to these Terms, you waive your right to participate in a class action lawsuit or class-wide arbitration against NilPilot or DRACONES Ecosystem.
Before initiating arbitration, we encourage you to contact us at nilpilot@polsia.app — most issues can be resolved quickly and informally.
